Client charged with 2 counts of Aggravated Assault with a firearm, unlawful discharge of a firearm, and criminal damage. Client alleged to have attacked victim with collapsible baton, pointed a gun victim, and fired gun at victim’s property. Video of beginning of incident recorded by victim. Client’s risk was up to 15 years in prison, could have died while incarcerated. Client retained Marner Law immediately. Extensive investigation conducted including site visit and reconnaissance, review of massive amount of police body camera footage, extensive legal research and planning for self-defense and property defense trial arguments, immediate enrollment of client into multiple types of counseling, extensive mitigation interviews with family and acquaintances, lengthy background information sessions with client. Result = client entered plea agreement requiring NO prison or jail, 2 years of probation, anger management and community service.
