Client with no criminal history stopped for weaving. Blood draw was sub-standard and did not leave sample for retest. Conducted defense investigation with interviews of stop officer and blood draw officer. Engaged expert witness on blood draw procedures. Filed motion to suppress stop as unlawful. Affirmed jury trial. Day of trial, prosecution offers much better resolution, drops down to regular, first-time DUI. Client very pleased with outcome.
