Client ordered out, passed multiple field sobriety tests. Police ask about his drug use history and medications. Simply don’t like what he has to say. Client arrested. Blood drawn. No alcohol in blood. No active THC in blood. Only thing in blood was prescription medication which he took legally. Identified, in addition to factual innocence, a constitutional violation for prolonged stop seizure, and lack of probable cause for arrest. Blitzed the prosecution with case problems. Case dismissed the same week. A good win for an innocent man. A good reminder that sometimes people get arrested and prosecuted when they literally did nothing wrong.
